The agreement that governs every enquiry, quote and shipment through halméra.co.
By placing an enquiry, requesting a quote or placing an order through this website, you agree to these terms of trade. They form the basis of the contract between you (the buyer) and PT. Daya Bumi Halméra (the seller). If any part of these terms conflicts with a signed contract, the signed contract prevails.
Quotes are valid for 14 days unless stated otherwise. An order is confirmed only when we issue a written sales confirmation. Orders may be cancelled or amended only with our written agreement, and changes may affect price, specification or delivery timing.
All lots are graded and sampled before shipment according to the specification agreed in the sales confirmation. Pre-shipment inspection by a third party can be arranged at the buyer's request and cost. Claims must be reported in writing within 7 days of delivery and are limited to the value of the non-conforming goods.
Prices are quoted per metric tonne, in USD, and are exclusive of freight, insurance and local duties unless stated. Payment terms are agreed per order and typically require a deposit or an irrevocable letter of credit. Late payments may accrue interest at the statutory rate.
Shipments are made under the Incoterms® 2020 rules agreed in the sales confirmation, usually FOB or CIF from Indonesian ports. Risk passes to the buyer at the point agreed in the sales confirmation. Force majeure events beyond either party's control suspend obligations for their duration.
All content on this website, including text, images, branding and product information, belongs to PT. Daya Bumi Halméra or its licensors. You may use it only for evaluating our products and must not reproduce it commercially without written permission.
To the maximum extent permitted by law, our total liability for any claim arising from a contract or this website is limited to the invoice value of the goods in question. We are not liable for indirect, incidental or consequential losses.
These terms are governed by the laws of the Republic of Indonesia. Disputes that cannot be resolved amicably are submitted to the courts of Jakarta. For any question about these terms, use the contact page.
